The states claimed that they wanted to sell in-state lottery tickets online, but that the Justice Department’s broad interpretation of the Wire Act of 1961 was blocking their plans because the transmission of data over the Internet could inadvertently cross state lines. In 2009, New York’s lottery division and the Illinois governor’s office sent letters to the Department of Justice, pushing the federal government to review its position on the online transmission of lottery transaction data across state lines.
